TERMS OF ACCESS, INTELLECTUAL PROPERTY, & DISCLAIMER
NOTICE: This site, together with every other domain, subdomain, page, file, node, feed, communication, and interactive feature that is owned or controlled by the Operator, that links to or incorporates these terms, or that is operated in connection with them (collectively, the "Site"), is owned, maintained, and operated strictly by Spencer H. Bromberg, an individual residing in Dallas County, Texas, acting in a private and personal capacity (the "Operator"). The Site is published for any purpose the Operator elects and is not limited to, defined by, or scoped to any particular subject, category, genre, or use. Accessing, viewing, or interacting with any part of the Site constitutes unconditional, binding acceptance of the terms below, including the ARBITRATION AGREEMENT, CLASS ACTION WAIVER, and JURY TRIAL WAIVER in Section 10. If you do not agree to every term, disconnect immediately.
1. COPYRIGHT, TRADEMARK, & INTELLECTUAL PROPERTY
All content, text, puzzles, design, code, conceptual material, data, and media published on or through the Site is © 2026 S. H. Bromberg. All rights reserved. No portion of the Site may be reproduced, mirrored, framed, scraped, crawled, indexed by automated tools, ingested into machine learning or artificial intelligence systems, or utilized for commercial or derivative purposes without the Operator's explicit, hand-signed prior written consent. All rights not expressly granted are reserved.
TEXT AND DATA MINING RESERVATION: The Operator expressly reserves all rights in the Site's content against text and data mining, machine learning, and artificial intelligence training or ingestion, by any means, including for purposes of Article 4(3) of Directive (EU) 2019/790 and any analogous law. This reservation is intended to be machine-readable and is repeated in the Site's technical configuration where practicable. Access to the Site by any automated agent, bot, crawler, or scraper is unauthorized and constitutes trespass to the Operator's property.
TRADEMARKS: All names, titles, marks, logos, and designations of the Operator appearing on the Site are the property of the Operator. No license or right to use any of them is granted, expressly or by implication. Third-party names and marks, where they appear, are the property of their respective owners and are used only for reference, description, commentary, or comparison.
INJUNCTIVE RELIEF: You acknowledge that any breach of this Section would cause the Operator irreparable harm for which monetary damages are inadequate, and that the Operator is entitled to injunctive and other equitable relief for any such breach without posting bond and in addition to all other remedies.
2. ABSOLUTE ZERO SAFE HARBOR & NON-AUTHORIZATION
The Operator grants NO authorized testing scope, safe harbor, immunity, or permission to perform security research, vulnerability scanning, probing, packet-injection, penetration testing, or auditing of any kind against the Site, its domains, or its underlying infrastructure. Any attempt to probe, scan, test, reverse-engineer, overload, or access non-public, restricted, or hidden endpoints is strictly unauthorized, constitutes intentional trespass and unauthorized access under applicable computer fraud and abuse statutes, and violates all applicable domestic and international laws. The Operator reserves all unfettered rights to pursue civil remedies and criminal referrals.
3. NO PROFESSIONAL CAPACITY, ADVICE, SOLICITATION, OR OFFER
The Operator acts solely in a private, personal capacity. Nothing on the Site is, or shall be construed as, legal, financial, investment, tax, medical, technical, or other professional advice, and nothing on the Site establishes any attorney-client, professional-client, fiduciary, confidential, or contractual relationship of any kind. No act, omission, publication, email exchange, submission, interaction, or alleged agreement, whether verbal, electronic, or implied, shall create any duty of care, binding commitment, or formal representation whatsoever.
NOT ATTORNEY ADVERTISING: The Site is a personal publication. It is not an advertisement for legal services, does not solicit clients or legal matters, and is not intended to and does not constitute attorney advertising or a solicitation under the rules of any jurisdiction. Any reference to the Operator's profession or credentials is biographical only.
NO FINANCIAL OFFER: Nothing on the Site is an offer to sell, a solicitation of an offer to buy, or a recommendation of any security, token, cryptocurrency, digital asset, financial product, or investment. References to keys, ciphers, ledgers, or cryptography are expressive, mathematical, or technical, and do not denote or offer any financial instrument or value.
EXCLUSIVITY OF WRITTEN CONTRACT: No agreement, binding obligation, partnership, license, retainer, or professional engagement of any nature with the Operator shall ever exist or be implied unless and until it is embodied in a comprehensive, physical, hand-signed written document explicitly executed by the Operator. Absent such a specific, physical, hand-signed writing, zero legal or professional duties, obligations, or representations exist.
4. NON-COMMERCIAL STATUS
The Site is a personal, non-commercial publication. The Operator does not sell, lease, or provide goods or services through the Site, does not charge for access, and does not conduct any consumer transaction through the Site. No access to or interaction with the Site is a purchase, lease, or acquisition of goods or services, and no visitor is a customer, client, or consumer of the Operator. The Site is not operated as a business, trade, or commercial enterprise, and the Operator is not a merchant, seller, service provider, data controller, or business for purposes of any consumer-protection, deceptive-trade, or data-privacy statute, to the fullest extent such statutes permit that characterization.
5. OPINION, FICTION, & ARTISTIC EXPRESSION
The Site consists of creative, artistic, mathematical, and personal expression. Except where expressly stated as fact, all statements on the Site are opinion, hypothesis, satire, parody, fiction, metaphor, puzzle, or artistic device, and are not assertions of fact about any person, entity, product, or event. References to real persons, entities, works, or events are for commentary, criticism, homage, reference, or description, do not imply any affiliation, endorsement, or sponsorship, and are made as nominative and descriptive fair use. No statement on the Site is intended to be understood as a statement of fact about any identifiable living person.
6. ABSOLUTE LIMITATION OF LIABILITY & WARRANTY EXCLUSION
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENTS, MATERIALS, AND SERVICES ARE PROVIDED ENTIRELY "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, ERRORS, OMISSIONS, AND DEFECTS. THE OPERATOR DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
UNDER NO CIRCUMSTANCES SHALL THE OPERATOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS, USE, INABILITY TO USE, OR RELIANCE UPON ANYTHING ON THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
EXPRESS NEGLIGENCE: THE FOREGOING RELEASE AND LIMITATION APPLY TO, AND YOU EXPRESSLY RELEASE THE OPERATOR FROM, ANY AND ALL CLAIMS ARISING IN WHOLE OR IN PART FROM THE OPERATOR'S OWN NEGLIGENCE, SOLE NEGLIGENCE, CONCURRENT NEGLIGENCE, OR GROSS NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW. THIS PARAGRAPH IS INTENDED TO SATISFY THE EXPRESS NEGLIGENCE AND FAIR NOTICE REQUIREMENTS OF TEXAS LAW.
7. DATA, PRIVACY, AUTOMATED SYSTEMS, & SUBMISSIONS
By accessing the Site, you acknowledge and agree that the Operator may collect, retain, aggregate, analyze, correlate, anonymize, de- anonymize, process, transmit, disclose, license, sell, or otherwise use or exploit, for any purpose and by any means whatsoever, any data of any kind arising from or connected to your access or interaction, including but not limited to metadata, network identifiers, device and browser characteristics, interaction patterns, submitted content, and any information you volunteer through any channel, without notice, consent beyond that implied by access, compensation, accounting, or restriction, and without any obligation of confidentiality, retention limit, correction, or deletion.
The Operator may employ artificial intelligence, machine learning, automated agents, or third-party processors in any capacity in connection with the Site, including to generate, moderate, analyze, respond to, transform, or act upon any content or data, whether originating from the Operator or from you. Any content, submission, or communication you provide to the Site may itself be ingested, processed, or transformed by such systems without further notice.
SECURITY CHECKS: The Site uses Cloudflare Turnstile, including in invisible mode, to distinguish people from automated traffic. Cloudflare's collection and use of data for that purpose are governed by Cloudflare's Turnstile Privacy Addendum, https://www.cloudflare.com/en-gb/turnstile-privacy-policy/.
SESSION RECORDING AND COOKIES: The Site records each visit as a session recording, capturing the pages viewed and the changes, pointer movement, clicks, and scrolling on them; text typed into any field is masked in the recording. The Site sets two cookies: a visitor cookie (v), kept for one year, that links visits from the same browser, and a session cookie (s), which expires after thirty minutes without activity, that links the pages of a single visit. Recordings are kept encrypted. Accessing the Site constitutes your prior consent to the session recording and to these cookies, for each visit and for every page viewed, including for purposes of any law that requires the consent of a party to the recording or interception of a communication.
UNSOLICITED SUBMISSIONS: Any idea, suggestion, solution, proposal, correction, or other material you submit to the Operator by any means is non-confidential and non-proprietary. The Operator may use, reproduce, disclose, and exploit it for any purpose, without acknowledgment, attribution, or compensation, and you waive any claim of authorship, co-authorship, or contribution arising from it.
You represent and warrant that you possess all rights necessary to submit any data or content you provide, and you assume sole responsibility and liability for having done so. The Operator makes no representation that any data will be kept private, secure, or confidential, and disclaims all liability for any collection, use, loss, or disclosure of data arising from your access to the Site. Where mandatory data-protection law grants rights that cannot be waived by agreement, this section applies to the fullest extent such law permits and no further.
8. INDEMNIFICATION & MODIFICATION
INDEMNIFICATION: YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE OPERATOR FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING ATTORNEY'S FEES) ARISING FROM YOUR INTERACTION WITH OR ACCESS TO THE SITE, YOUR SUBMISSIONS, OR YOUR VIOLATION OF ANY TERM HEREIN, INCLUDING CLAIMS ARISING IN WHOLE OR IN PART FROM THE OPERATOR'S OWN NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW.
MODIFICATION: The Operator reserves the absolute right to alter, amend, update, or revoke these terms, the Site's structure, or its accessibility at any time, unilaterally, with or without prior notice. Continued interaction with the Site constitutes binding acceptance of any such modifications.
9. GOVERNING LAW, VENUE, FEES, & PROTECTED EXPRESSION
GOVERNING LAW: These terms and any dispute, claim, or controversy arising out of or relating to the Site or the Operator shall be governed exclusively by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles that would apply the law of any other jurisdiction.
VENUE: Subject to Section 10, any legal action or proceeding against the Operator shall be brought exclusively in the state or federal courts located in Dallas County, Texas. You irrevocably consent and submit to the personal jurisdiction of those courts and waive any objection to venue or forum non conveniens.
ATTORNEY'S FEES: To the fullest extent permitted by law, including Chapter 38 of the Texas Civil Practice and Remedies Code, the Operator shall recover all reasonable attorney's fees, costs, and expenses incurred in enforcing these terms or in defending any claim brought against the Operator that is dismissed, withdrawn, or resolved in the Operator's favor in whole or in part.
PROTECTED EXPRESSION: The Site is an exercise of the Operator's rights of free speech, free expression, and free association. Any legal action based on, relating to, or in response to the Operator's exercise of those rights is subject to Chapter 27 of the Texas Civil Practice and Remedies Code and any analogous law, and the Operator reserves all rights thereunder, including early dismissal and recovery of fees, costs, and sanctions.
10. BINDING ARBITRATION, CLASS ACTION WAIVER, & JURY TRIAL WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
AGREEMENT TO ARBITRATE: ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR THE OPERATOR, INCLUDING THE FORMATION, EXISTENCE, VALIDITY, SCOPE, INTERPRETATION, ENFORCEABILITY, OR BREACH OF THESE TERMS OR OF THIS SECTION, SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS CONSUMER ARBITRATION RULES, OR IF THOSE RULES ARE UNAVAILABLE, ITS COMMERCIAL ARBITRATION RULES, BEFORE A SINGLE ARBITRATOR, SEATED IN DALLAS COUNTY, TEXAS. THIS AGREEMENT TO ARBITRATE IS GOVERNED BY THE FEDERAL ARBITRATION ACT, 9 U.S.C. § 1 ET SEQ., AND EVIDENCES A TRANSACTION INVOLVING INTERSTATE COMMERCE. THE ARBITRATOR, AND NOT ANY COURT, SHALL HAVE EXCLUSIVE AUTHORITY TO RESOLVE ANY DISPUTE RELATING TO THE INTERPRETATION, APPLICABILITY, OR ENFORCEABILITY OF THIS SECTION.
EXCEPTIONS: Either party may bring an individual claim in small claims court in Dallas County, Texas, if it qualifies. The Operator may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or to enforce Sections 1, 2, or 7.
CLASS ACTION WAIVER: YOU AND THE OPERATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THEN THE AGREEMENT TO ARBITRATE SHALL NOT APPLY TO THAT CLAIM, AND THAT CLAIM SHALL BE LITIGATED ON AN INDIVIDUAL BASIS EXCLUSIVELY IN THE COURTS IDENTIFIED IN SECTION 9, AND THIS CLASS ACTION WAIVER SHALL CONTINUE TO APPLY TO THAT LITIGATION TO THE FULLEST EXTENT PERMITTED BY LAW.
JURY TRIAL WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE OPERATOR KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, WHETHER IN ARBITRATION, IN COURT, OR OTHERWISE. THIS WAIVER IS CONSPICUOUS AND IS A MATERIAL INDUCEMENT TO THE OPERATOR'S PUBLICATION OF THE SITE.
CONFIDENTIALITY OF ARBITRATION: The existence, content, and result of any arbitration shall be confidential, except as necessary to enforce an award or as required by law.
11. LIMITATION PERIOD & CAP ON DAMAGES
ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS MUST BE COMMENCED WITHIN TWO (2) YEARS AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES, OR IT IS PERMANENTLY AND IRREVOCABLY BARRED, NOTWITHSTANDING ANY LONGER STATUTE OF LIMITATIONS THAT WOULD OTHERWISE APPLY. THIS PERIOD IS INTENDED TO COMPLY WITH SECTION 16.070 OF THE TEXAS CIVIL PRACTICE AND REMEDIES CODE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT, IF ANY, YOU PAID TO THE OPERATOR FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE UNITED STATES DOLLAR ($1.00).
12. SEVERABILITY & NO WAIVER
If any provision of these terms is held invalid, illegal, or unenforceable in any jurisdiction, that provision shall be limited or eliminated only to the minimum extent necessary so that these terms otherwise remain in full force and effect and enforceable as against you to the maximum extent permitted in that jurisdiction, except as expressly provided in Section 10 regarding the Class Action Waiver. No failure or delay by the Operator in exercising any right hereunder shall operate as a waiver of that or any other right, and no waiver is effective unless in a hand-signed writing executed by the Operator.
13. TERMINATION, ASSIGNMENT, & NO THIRD-PARTY BENEFICIARIES
The Operator may deny, restrict, suspend, or terminate any person's access to the Site, in whole or in part, at any time, for any reason or no reason, with or without notice, without liability of any kind. The Operator may freely assign, transfer, sublicense, or delegate any or all of its rights and obligations under these terms without your consent. You may not assign or transfer any right or obligation under these terms without the Operator's prior written consent, which may be withheld for any reason. These terms confer no right, benefit, or remedy on any person or entity other than the Operator and the Operator's heirs, successors, and assigns.
14. FORCE MAJEURE
The Operator shall not be liable for any failure, delay, interruption, or unavailability of the Site, in whole or in part, arising from any cause beyond the Operator's reasonable control, including but not limited to acts of God, internet or infrastructure failure, hosting or network provider outages, cyberattack, power failure, governmental action, or any other event of similar or dissimilar character.
15. AGE, CAPACITY, & ELIGIBILITY
The Site is not directed to, and is not intended for use by, anyone under the age of majority in their jurisdiction of residence. By accessing the Site, you represent and warrant that you have reached the age of majority where you reside and possess the full legal capacity to be bound by these terms. The Operator does not knowingly collect information from anyone below that age, and any such access is unauthorized and outside the scope of any permission granted herein.
16. TERRITORIAL SCOPE, NO TARGETING, EXPORT CONTROL,
& JURISDICTIONAL RESTRICTIONS CONTROL AND OPERATION: The Site is controlled and operated by the Operator from within the State of Texas, United States of America. The Operator makes no representation that the Site, or any content, material, or function made available through it, is appropriate, available, or lawful for use in any location outside Texas. Persons who choose to access the Site from other locations do so on their own initiative and at their own risk, and are solely responsible for compliance with all applicable local laws.
NO TARGETING; NO INTENT TO DISTRIBUTE: The Site is a passive publication. It is not directed to, targeted at, or intended for distribution to or use by any person or entity in any jurisdiction or country where such publication, distribution, access, or use would be contrary to law or regulation, or would subject the Operator to any registration, licensing, or other requirement within that jurisdiction. The Operator does not solicit, transact, or purposefully avail itself of the privilege of conducting activities in any jurisdiction other than Texas, and nothing on the Site shall be construed as an intent to do so. The mere technical accessibility of the Site from any location is not, and shall not be deemed, an offer, distribution, direction, or targeting of that location. The Operator may, without notice, restrict or block access from any location.
EXPORT CONTROL & CRYPTOGRAPHIC COMPLIANCE: The Site may contain, reference, or make available cryptographic material, including public key data. You represent and warrant that your access to, download of, or use of any such material complies with all applicable export control, sanctions, and cryptography laws of your jurisdiction and of the United States, and that you are not located in, under the control of, or a national or resident of any country or party subject to applicable export restriction or embargo. The Operator assumes no responsibility for your compliance and bears no liability for any consequence of your access from a restricted jurisdiction.
PROHIBITED ACCESS: If access to, participation in, or use of the Site or any content made available through it is prohibited, restricted, or unlawful under the law of your jurisdiction for any reason, you are not authorized to access the Site and must not do so. You are solely responsible for determining whether your access is lawful where you are. Accessing the Site from a jurisdiction where it is prohibited is at your sole risk, is outside the scope of any permission granted herein, and is a violation of these terms.
17. THIRD-PARTY SITES, LINKS, & CONTENT
The Site may contain links to, embed, or reference websites, platforms, services, content, or materials owned or operated by third parties, including but not limited to video, social, archival, publishing, and commerce platforms. Such links and references are provided solely as a convenience. The Operator does not control, endorse, sponsor, verify, or assume responsibility for any third-party site, content, product, service, policy, or practice, and disclaims all liability arising from your access to or use of any of them. Your dealings with any third party are solely between you and that third party.
18. COMMUNICATIONS, AUTHENTICITY, & CONDUCT
NO OBLIGATION TO RESPOND: The Operator has no obligation to read, acknowledge, respond to, or act upon any communication, submission, or request, and silence or non-response shall not be construed as acceptance, agreement, admission, or waiver of anything.
AUTHENTICITY: No communication, message, post, or content purporting to originate from the Operator is authentic unless it is cryptographically signed with a key the Operator has published on the Site, or is otherwise expressly confirmed by the Operator in a hand- signed writing. The Operator is not responsible for any impersonation, spoofing, or unauthorized use of the Operator's name, likeness, marks, or identity by any third party.
CONDUCT: You shall not use the Site or any information obtained from it to harass, threaten, stalk, dox, defame, impersonate, or otherwise harm the Operator or any other person, and shall not attempt to identify, locate, or contact the Operator by any means other than those the Operator publicly designates. The Operator reserves all civil and criminal remedies for any such conduct.
19. ELECTRONIC ACCEPTANCE, RECORDS, NOTICE, & SURVIVAL
Your access to the Site constitutes electronic acceptance of these terms with the same force and effect as a physical signature, notwithstanding the hand-signed-writing requirement described in Section 3 for any separate agreement with the Operator. These terms are made available on the Site, are linked from the Site's pages, and are incorporated by reference into every page, file, and feature of the Site.
RECORDS: You agree that the Operator's and its providers' server, access, and system logs and records are accurate records of your access and interaction and are admissible in any proceeding to the same extent as business records maintained in the ordinary course.
NOTICE: Any notice to the Operator is effective only if delivered by the means the Operator designates from time to time, and only upon the Operator's actual, acknowledged receipt.
SURVIVAL: Sections 1 through 12, 16, 17, 18, 20, 21, 22, and this Section 19 survive any termination or expiration of your access to the Site, indefinitely.
20. NO GUARANTEE OF OUTCOME OR RESULT
The Site and its content are provided for whatever purpose the Operator elects and are not restricted to any category, genre, or use. The Operator makes no representation or warranty concerning any content, feature, sequence, or interaction, including without limitation that any puzzle, challenge, question, problem, or sequence is solvable or that a solution exists; that any content is accurate, complete, current, or meaningful; or that reaching any stage, condition, or result entitles you to any further content, response, recognition, compensation, or prize of any kind. The Operator retains sole and unfettered discretion over the design, rules, availability, continuation, alteration, and termination of any content or feature, at any time, without notice or obligation. Nothing on the Site constitutes an offer, contest, sweepstakes, promotion, solicitation, or invitation unless expressly and separately designated as such by the Operator in a hand-signed writing.
21. ASSUMPTION OF RISK
Any action you take in connection with content found on or derived from the Site, including but not limited to research, travel, expenditure, communication with third parties, disclosure of information, or participation in any activity suggested, implied, or inferred from the Site's content, is undertaken entirely at your own discretion and risk. The Operator has no duty to warn, supervise, or protect you in connection with any such action and disclaims all liability for any consequence of it, foreseeable or not.
22. ACCESSIBILITY
The Site is a personal, non-commercial publication and is not a place of public accommodation, a commercial facility, or a public service. The Operator nonetheless endeavors, on a best-effort basis and without obligation, to publish content in plain, standards-based formats. No representation is made that the Site conforms to any accessibility standard. If any content is inaccessible to you, the Operator will consider reasonable requests for an alternative format made through the means the Operator publicly designates, without undertaking any obligation to provide one.
23. ENTIRE AGREEMENT & INTERPRETATION
These terms, as they exist at the time of your access, constitute the entire and exclusive agreement between you and the Operator regarding the Site and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. You acknowledge that you have not relied on any statement, promise, or representation not expressly contained herein. Section headings are for convenience only and do not affect interpretation. The word "including" means "including without limitation" wherever it appears. No course of dealing, trade usage, or prior version of these terms shall be used to interpret or vary their plain meaning. These terms shall not be construed against the Operator as drafter.
